The following conditions apply to shipping within the Federal Republic of Germany and the European Union. The separate shipping conditions for deliveries to other foreign countries can be found below.
1. Prices, shipping costs, return costs
1.1. All prices include statutory German VAT.1.2. All orders are free of postage and packaging1.3. You have to bear the costs of the return if the goods delivered correspond to those ordered.
2. Withdrawal
2.1. The following right of withdrawal does not apply to sealed goods if you open or damage the sealed packaging (unsealing).2.2. You can revoke your contractual declaration within two weeks without giving reasons in text form (e.g. letter, fax, email) or by returning the item. The period begins at the earliest upon receipt of this instruction. To meet the cancellation deadline, it is sufficient to send the cancellation or the item in a timely manner.2.3. The revocation must be sent to: NEOS Music GmbH, Tegernseer Landstraße 135, 81539 Munich, Germany.
3. Consequences of revocation
3.1 In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest) must be returned. If you cannot return the service received to us in whole or in part or only in a deteriorated condition, you may have to pay us compensation. This does not apply to the transfer of items if the deterioration of the item is solely due to their inspection - as would have been possible in a store. Furthermore, you can avoid the obligation to pay compensation by not using the item as an owner and refraining from anything that would impair its value.3.2. You must bear the costs of the return.3.3. Notes on returns: Please stamp the return properly. Please note: we refuse to accept shipments sent freight forwarded. Packs and sets can only be returned if complete. If necessary, a credit note or other reimbursement of the return costs will be made at the purchaser's discretion.
4. Payments, delivery, reservation of delivery
4.1. For deliveries within Germany / the EU, shipping takes place from the warehouse by post, usually within one week of receipt of the order. Delivery is subject to the condition that we ourselves receive delivery correctly and on time. We will inform the customer immediately if there is a lack of availability. Any payments will be refunded immediately. We reserve the right to only deliver items with limited availability in normal household quantities.4.2. Delivery is made exclusively by payment in advance, credit card, cash on delivery (Germany only) or direct debit (Germany only). Liability cannot be assumed if cash or checks are lost.4.3 If you default on your payments, we reserve the right to charge you the statutory default interest. Consumers therefore pay 5 percentage points above the respective rate set by the Federal Central Bank (
bundeszentralbank.de/ezb) announced basic interest rate of interest per year. For other legal transactions in which a consumer is not involved, 8 percentage points above the base interest rate are due. You remain entitled to prove that we have suffered no or only minor damage caused by the delay.
5. Retention of Title
5.1. The delivered goods remain our property until full payment has been made. Until then, you must treat the goods with care and report any damage immediately.5.2. In the event of late payment, we are entitled to withdraw from the contract and demand the return of the goods. The costs of returning the goods in the event of default are at your expense and must be reimbursed if you did not bear them yourself.

6.1. We store and use your data for the purposes of customer administration, contract processing itself, any credit checks and for marketing. Of course, we need your address and communication data for your orders and order processing. We also save your open and completed orders for you.
7. Place of Jurisdiction, Partial Invalidity, Applicable Law
7.1. In business transactions with merchants and with legal entities under public law, the place of jurisdiction for all legal disputes arising from the contract, including bill of exchange and check lawsuits, is agreed to be Munich. We are also entitled to sue at the registered office of these customers.7.2. If individual provisions of the delivery contract or these general terms and conditions are ineffective, the remaining provisions remain in effect (severability clause).7.3. The law of the Federal Republic of Germany applies to legal transactions or other legal relationships with NEOS Music GmbH. In the case of contracts for a purpose that cannot be attributed to the professional or commercial activity of the beneficiary (consumer), this choice of law only applies to the extent that the protection granted is not covered by mandatory provisions of the law of the country in which the consumer has his habitual residence, is withdrawn.
